Terms and Conditions

Article 1 Definitions

1. Lia-May: Lia-May established in Nijverdal, Chamber of Commerce no. 82850097

2. Customer: the person with whom Lia-May has concluded an agreement.

3. Parties: Lia-May and the customer together.

4. Consumer: an individual who acts for private purposes.

Article 2 Prices

1. All prices charged by Lia-May are in euros, include VAT and exclude any other costs such as administration costs, levies and travel, shipping or transport costs, unless expressly stated or agreed otherwise.

2. Lia-May is entitled to adjust all prices for its products or services, displayed in its store, on its website or otherwise, at any time.

3. Increases in the cost prices of products or parts thereof, which Lia-May could not foresee at the time of making an offer or concluding the agreement, may give rise to price increases.

4. The consumer has the right to cancel an agreement as a result of a price increase as referred to in paragraph 3, unless the increase is the result of statutory regulations.

Article 3 Applicability

1. These terms and conditions apply to all quotations, offers, activities, orders, agreements and deliveries of services or products by or on behalf of Lia-May.

2. Parties can only deviate from these terms and conditions if they have expressly agreed to this in writing.

3. The parties expressly exclude the applicability of additional and/or deviating general terms and conditions of the customer or of third parties.

Article 4 Payments and payment term

1. Lia-May may require a down payment of a maximum of 50% of the agreed amount when concluding the agreement.

2. The customer must have paid the full amount within 7 days after delivery of the product.

3. Payment terms are regarded as strict payment terms. This means that if the customer has not paid the agreed amount at the latest on the last day of the payment term, he is legally in default, without Lia-May sending the customer a reminder or giving him notice of default.

4. Lia-May reserves the right to make a delivery conditional on immediate payment or to demand sufficient security for the total amount of the services or products.

Article 5 Right of recovery of goods

1. As soon as the customer is in default, Lia-May is entitled to invoke the right of collection with regard to the unpaid products that have been delivered to the customer.

2. Lia-May invokes the right of recovery by means of a written or electronic communication.

3. As soon as the customer has been informed of the claimed right of recovery, the customer must immediately return the products concerned to Lia-May, unless the parties agree to make other arrangements in this regard.

4. The costs for collecting or returning the products are for the account of the customer.

Article 6 Right to cancellation

1. A consumer can cancel an online purchase during a cooling off period of 14 days without giving reasons, provided the product has not been used

it is not a product that can spoil quickly, such as food or flowers

the product is not specifically tailored to the consumer or adapted to his special needs

it is not a product that cannot be returned for hygienic reasons (underwear, swimwear, etc.)

the seal is still intact if the product is a data carrier with digital content (DVDs, CDs, etc.)

the product is not a (holiday) trip, ticket, catering order or a form of leisure activity, the product is not a separate magazine or newspaper

the purchase does not concern (order for) emergency repairs

the consumer has not waived his right of withdrawal

2. The reflection period of 14 days as referred to in paragraph 1 starts

on the day after the consumer has received the last product or part of 1 order

as soon as the consumer has first received the product of a subscription

as soon as the consumer has purchased a service for the first time

once the consumer has confirmed the purchase of digital content over the internet

3. The consumer can make his right of withdrawal known via info@lia-may.com.

4. The consumer is obliged to return the product to Lia-May within 14 days after notification of his right of withdrawal, after which his right of withdrawal lapses.

5. The costs for return shipment are for the account of Lia-May if the complete order is returned.

6. If the purchase costs and any other costs (such as shipping and return costs) are eligible for reimbursement according to the law, Lia-May will refund these costs to the consumer within 14 days after receipt of the timely appeal to the right of withdrawal, provided that the consumer has returned the product to Lia-May in a timely manner.

Article 7 Right of retention

1. Lia-May can invoke its retention of title and in that case keep the products sold by Lia-May to the customer until the customer has paid all outstanding invoices with regard to Lia-May, unless the customer for these payments has provided adequate security.

2 The right of retention of title also applies under previous agreements from which the customer still owes payments to Lia-May.

3. Lia-May is never liable for any damage that the customer may suffer as a result of using his retention of title.

Article 8 Lia-May .'s liability

1. Lia-May is only liable for damage suffered by the customer if and insofar as this damage is caused by intent or gross negligence.

2. If Lia-May should be liable for any damage, then it is only liable for direct damage arising from or related to the execution of an agreement.

3. Lia-May is never liable for indirect damage, such as consequential damage, lost profit, lost savings or damage to third parties.

4. If Lia-May should be liable, this liability is limited to the amount that in the relevant case under a closed (professional) liability insurance.

5. All images, photos, colours, drawings, descriptions on the website or in a catalog are only approximate, are indicative and cannot give rise to compensation and/or (partial) dissolution of the agreement and/or suspension of any obligation. .

Article 9 Transfer of rights

1. The customer cannot transfer his rights under an agreement with Lia-May to third parties without the prior written consent of Lia-May.

2. This provision applies as a stipulation with property law effect as referred to in Section 3:83(2) of the Dutch Civil Code.

Article 10 Visual material and products offered

1. You cannot derive any rights from the visual material associated with a product offered on our website and social media.

Article 11 Applicable law and competent court

1. All agreements between the parties are exclusively governed by Dutch law.

2. The Dutch court in the district where Lia-May is located has exclusive jurisdiction in the event of disputes

Between the parties, unless otherwise required by law.
